The following is a list of the main pieces of legislation on Japanese knotweed disposal and handling and summaries their salient points. Sellers of properties are also reminded that the Law Society’s TA6 property information form requires them to state whether the property is affected by Japanese knotweed. If you answer untruthfully, your buyer can either revoke the contract or demand damages from you. We have personally been involved in several disputes where a property has been sold and the previous owner has deliberately concealed any physical evidence of Japanese knotweed, while also clearly lying on the TA6 form. In every case, the new owner sought redress.
